RETURN POLICY
- Your rights to end the contract
8.1 Ending your contract with us. You may end your contract with us in the circumstances described below. Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract:
8.1.1 If what you have bought is faulty or misdescribed, you may have a legal right to end the contract, subject also to the conditions set in paragraph 11.
8.1.2 If you wish to terminate the contract due to our actions or notifications of intended actions, the contract will end immediately, and we will fully refund any unprovided products. Valid reasons for such termination include:
- 8.1.2.1 We have informed you about an upcoming significant change to the product or these terms, which you do not agree with.
- 8.1.2.2 We have notified you of an error in the product's price or description, and you do not wish to proceed.
- 8.1.2.3 There is a risk that supply of the products may be significantly delayed due to events beyond our control.
In these situations, you are entitled to terminate the contract immediately and receive a full refund for any products not provided.
8.1.3 If you have just changed your mind about the product. You may be able to get a full refund, but this may be subject to deductions, see also conditions set in paragraph 9.
8.1.3.1 How long do I have to change my mind? For most products bought online you have 30 days after the day you (or someone you nominate) receives the products, unless your products are split into several deliveries over different days. In this case you have until 30 days after the day you (or someone you nominate) receives the last delivery to change your mind about the products (our policy extends the EU statutory 14-day period to 30 days).
8.2 If you cancel your order before the products have been dispatched, you will receive a full refund of all amounts paid.
- How to end the contract with us (including if you have changed your mind)
9.1 Tell us you want to end the contract. To end the contract with us, please let us know by contacting us via email, via our contact page or via WhatsApp, by completing the Cancellation Request Form indicated in paragraph 12.
9.2 Returning products after ending the contract: if you end the contract for any reason after the product has been dispatched to you or you have received it, we will provide you with a return address and you shall send the product using a standard tracked delivery rate, if you wish to be fully refunded for delivery.
9.2.1 You must return the products with their original packaging, complete with all related accessories, labels, protective covers and boxes, the original invoice. Please take particular care NOT to break the seal with the tags attached to the bag. The removal of the tags may render the products unsuitable for resale and may result in a partial or full loss of refund rights, without affecting your statutory rights.
Products must be returned in resellable condition. We will not accept products which are worn, damaged, or soiled.
9.3 When we will pay the costs of return delivery. We will pay the costs of return delivery:
9.3.1 if the products are faulty or misdescribed;
9.3.2 if you are ending the contract because we have told you of an error in pricing or description, a major delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong; or
9.3.3 if you are exercising your right to change your mind.
9.3.4 In all other circumstances, you must pay the costs of return delivery.
9.3.5 Any reimbursement of return delivery costs is subject to our receipt and inspection of the returned products and confirmation that the conditions for reimbursement under this policy have been met.
9.4 How we will refund you. We will refund you the price you paid for the products including the standard tracked delivery cost you paid, using the same method you used for payment or, where this is not reasonably practicable, by another method expressly agreed with you (for example, a bank transfer).
However, we may make deductions from the price, as described below.
9.5 Deductions from refunds if you are exercising your right to change your mind. If you are exercising your right to change your mind:
9.5.1 We may reduce your refund of the price (excluding the standard tracked delivery cost) to reflect any reduction in the value of the products, if this has been caused by your handling them in a way which would not be permitted in a shop. Please note that the amount of the reduction could be equal to the full amount of the price if we are unable to sell the returned products because they do not meet our high standards of sale.
9.5.2 As standard tracked delivery is complimentary, we will not refund delivery costs if you choose to have the product delivered by Express or Premium delivery.
9.6 When your refund will be made. The refund will be issued within 14 days of receiving the returned product and confirming it meets the conditions set out in this policy.
- Our rights to end the contract
10.1 We may end the contract if you break it. We may end the contract for a product at any time by writing to you if:
10.1.1 you do not make any payment to us when it is due;
10.1.2 you do not, within a reasonable time, allow us to deliver the products to you.
10.2 You must compensate us if you break the contract. If we end the contract in the situations set out in paragraph 10.1 we will refund any money you have paid in advance for products we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.
- If there is a problem with the product
11.1 How to tell us about problems. If you have any questions, concerns or complaints about the product, please contact us. We are here to support you, address any concerns, and work with you to minimize inconvenience. Our goal is to ensure you feel protected and treated fairly, including securing any refund or compensation to which you may be entitled.
11.2 Your legal rights. We are under a legal duty to supply products that are in conformity with this contract. Nothing in these terms will affect your legal rights.
11.3 Your obligation to return rejected products. If you wish to exercise your legal rights to reject products, then you can follow the conditions set in paragraph 9.
11.4 Separate Repair Policy. This Return Policy governs only the cancellation, return and refund of products. It does not govern repairs, after-sales services or claims arising from wear and tear, accidental damage or issues occurring after the products have been used. Any repair services offered by Ornella Gorza Ltd shall be governed by a separate Repair Policy, which may contain different terms, conditions, exclusions and procedures (see related section under HELP)
